Here Mr. Dashrath Maheshwari has written that no need to repeat the answer because he is of the same opinion as of Dipesh and so he is writing that he is not giving answer and in stead of that he is giving his agreement to the reply by Dipesh and he is not saying other members that do not participate. You have posted reply without understanding his message and thinking that he is stopping others from participating using his moderatorship, but it is not so. I am just explaining you the meaning of his message.
Regards,
Khyati.

Thanks friend for your free advise though it was not needed at all. You have no idea about the good relationship DM is sharing with other members !!!
How can anyone misinterpret my reply towards other member of CAC? It was such a non-serious and light reply.

( but he is sure that it was aquired before 1969 Approx.) NOW MY QUETION IS........ 1) Can he assum that land was Purchased before 1.4.1981 & will take Fair Market Value on 1.4.1981? 2) In What way he can get the Fair Market Value of that particular (which is sold) land? 3) Now what is best option to save his Tax Liability in above case ? 4) Can he get exemption in any other head than CAPITAL GAIN? Dear Friends i have Given him Assurance that i will get it solved from CACLUBINDIA..... Hope i will Have desired Suggetions From ur side...................... THANX IN ADVANCE. Regards |
Dear SAN,
i have seen the post may be a little late but i have a few doubts. Pls go through the highlighted parts of the text you have quoted. Before a solution is arrived to the query there are a few things which need to be clarified. You said "SHARE of profit" pls clarify this term. Next is that is the land jointly held by his brothers and sisters or some one or is he the only person holding it.Holding here means according to the registration deed.
PLS clarify the above so that a better solution may be framed.

Hi SAN,
1st thing I would like to say is "DON'T Assume Unless Law Permits You to Assume". If U don't have any details it doesn't mean others, i mean, Regulatory body and the constitutional laws are unaware of it. If you want to Know, the exact Date and Amount when the land sold by ur friend was purchased, you can get it from Property Card, which is available in your city / district survey office. you can approach directly to the govt. departments instead of going thru any valuer. If you still can't get it. Let me know. I will try to help you out.

yes u can take fmv on 1981......and without knowing cost how can u calculate profit ..of rs 30000 i think u r saying that u got consideraion of rs. 30000 ...then u hvae to taje fmv from ...revenue department or u can take fair market value of land adjacent to u or in near by area for same kind of land as u have................................and i think u cant avail deduction as u r not using ur land for agricultural purpose.....to avial deduction u shall use u r land for agricultural purpose
