can we get credit of gst and penalty paid through drc-03 upon seize of goods without e-way bill and other documents

No for penalty you can't get credit

Please Guide as to how can we take credit of the Tax (not Penalty) portion of Payment done by DRC-03.

As the payment of Tax (not Penalty) done by DRC-03 does not appear in the Electronic Credit Ledger to be set off against the GST Liability of Sale.
