If rental agreement is not in the name of assessee then can he claim HRA?

No. Assessee cannot claim.
IF assessee paying rent, agreement should also be in his name.

No Sir, It can be claimed only when the Rental Agreement is in the name of Assessee because Employer is bound with some rules when he will allow only when it is the name of Assessee
