Please tell if the assessee is a company or what?
In my opinion, the following things should be considered
1. In case of partnership or propreitorship firm, a CA shall be conducting Tax audit of the assessee, and so he can sign the balance sheet of the assessee.
2. In case of company, the auditor is appointed in the AGM. The AGM which deals with appointment of auditor for the financial year 2012-13 must have been appointed in the AGM conducted somewhere in the month of August or september, 2012. At that time, the member concerned was not a CA and hence cant accept the audit and cant sign the balance sheet. He can however sign the tax audit report in my view. Further, you can also change the CA. The previous CA can give in writing his resignation and then the shareholders can appoint another CA in General meeting.
