Ca partner itr 3 or 4

A new CA is  a partner in in a CA firm and earning salary but no share in profit.  CA is also practising in his indivudual name and earning income. Then which ITR is to be filed ITR 3 or ITR 5. and what would be due date of filing ROI if accounts of the firm is audited u/s 44AB.

a partner must have partnership share in the firm

hence the person needs to file itr 4, 

But Ashish, a salaried partner need not have any share in profits. Is it not so. ?

how can be a partner be a partner without any share,, internally it can be any things but on books he has to be shown as partner name in partnership deed.
