Two questions in May 2011 CA final Law paper were regarding Winding Up.

One question was about contributory in relation to winding up & other question was regarding factors High Court should consider for winding up petetion filed by registrar on account of liabilities far exceeding assets.

Both questions were out of syllabus as per the notification of ICAI here: www.icai.org/resource_file/19954list_pubnov2010exam.pdf

extract: [Students have been advised to study only the general provisions of winding up as covered under Paragraph 9.4 of chapter 9 of the study material]

Both the topics are not included in para 9.4 of the said chapter.

ICAI plays foul, with us students, AGAIN.

So, what's the remedy?

I'd put this question to CA Vinod Jain during the CA students convention at Bangalore regarding IFRS question which had come in the May 2010 exam which was out of syllabus... Similar thing has happened now.. He'd told tat if such things happen, then the students would be awarded marks.. Hope to rely on his statement.. What else can we do!!!!!!!! But such things are seriously not happening!!!!!!!!!!!!!!!!!!!!!!!
