NO.
Members of the ICAI in practice who are otherwise eligible may practise as advocates subject to the permission of the Bar Council but in such case, they should not use designation ‘Chartered Accountant’ in respect of the matters involving the practice as an advocate. In respect of other matters they should use the designation ‘Chartered Accountant’ but they should not use the designation ‘Chartered Accountant’ and ‘Advocate’ simultaneously.
Council direction under Clause (7) of Part I of the First Schedule to the The Chartered Accountants Act, 1949
.
Section 33 of The Advocates Act, 1961 bars any other professional to practice in any court or before any authority etc. Section 49 of the Advocates Act gives general powers to the Bar Council of India to make such rules. Under this power the Bar Council of India has framed the rules which prohibits an advocate from engaging in any other profession other than practicing the profession of law.
Although ICAI has granted the permission for practicing the profession of law but it is subject to prior permission from the Bar Council of India. On the other hand, Bar Council of India does not allow any other professional to practice the profession of law as stated above. Hence, it is not possible for an individual to practice both the professions simultaneously.
