An employee has left the company without giving any letter of resignation or any intimation to the company. The employee is covered under the bonus act,1965 & bonus payable to him is outstanding in the books of company for last one year.

Is the company liable to send cheque at the adress of this employee since bonus act prescribe time limit of only 8 months? But if company do so than isn't it unfair that employee is leaving the company without  any resignation letter & also he is getting the privilege of getting bonus at his address?

Pls quote relevant section. i am facing this problem in my audit as companyis refusing to pay bomus since it wants to harass the employee as he has left witout intimation

Not much idea. . . But i think company is not responsible for it.
