Auditor's unwillingness to get appointed/reappointed

Hi

An Auditor (whether be a Retiring or a new auditor) has given his consent to the company for his appointment if made will be in accordance with the limits prescribed u/s 224(1B) and with reference to the consent letter the Company have appointed the said auditor in AGM and also intimated the said auditor about his appointment/Reappointment within 7 days 

But Now after receiving the intimation the said auditor gives his unwillingness in writing to the company of not to be appointed or reoppointed as auditor (Note: Here there is no case of Casual Vacancy)

Now what will the Company Do for appointing another auditor since AGM was already over?????. 

From my point of view -The Central Government will have to appoint another auditor

Hello Sunny,

After receiving intimation from co., the audior is required give his intimation to ROC witin 30 days specifying the fact wether he is accepted the appointment or not.

So, in the given case auditor may refuse to accept through ROC not directly to co.

Further, you are right that the appointment will now be made by Govt. u/s 224(3)/(4). 

Dear Mohit

If the Auditor directly inform ROC about his Refusal then how the Company will receive the Information

Can u tell me the Further Procedure from "The Auditor informing ROC about Acceptance or Refusal"
