The procedure for transfer is to get form 109 signed by principal.
Getting a transfer is possible only by mutual consent, death of principal or by opting for industrial training (N.A for 1st and 2nd yr articled asst).
If the mutual consent is not there...then what should the student do??? Its a tough question indeed, and trust me its not answered yet.
Thats one reason, the students who want a transfer face difficulties. This is because of this unanswered question which becomes an advantage for members.
As we know that if the mutual consent is not there then the further course of action is not known.ICAI has no answer in its current regulations. So, if there is no mutual consent then there is no transfer under current rules. This means that you have to give up your fundamental rights and work with your principal even if you are not interested.
May god help all those who are seeking transfer and having no mutual consent.
