No...Sec 314 will not be attracted....
Sec 314 is not applicable when some one is provides services of professional nature without being on regular pay..............
I assume technical advisor is professional and is hired for some assignment............

If the appointment is as a technical adviser on retainership basis, then yes, 314 will be attracted.

the important thing is if it is assignment based job or one time then it will not be applicable but if it is on retainership model or regular nature u will have to comply the section
