Appointment of CEO & MD at the same time

22 June 2022As per Section 203(1) of the Companies Act, 2013,
Every company belonging to such class or classes of companies as may be prescribed* shall have the following whole-time key managerial personnel,—
(i) managing director, or Chief Executive Officer or manager and in their absence, a whole-time director;
*Every listed company and every other public company having a paid-up share capital of ten crore rupees or more.
Hence either of 1 of MD/CEO/Manager/WTD is mandatory for prescribed cos. But you can voluntarily appoint, there is no restriction.
Coming to your question, if you mean whether you can appoint same person as CEO & MD at the same time, then yes there is no restriction on the same though it is redundant. Or alternatively, if you are asking whether Company can appoint a CEO & a MD at the same time, then answer then also is yes, they can.
