Applying for import export code online

Hello Everyone,

 

I checked the forums but wasn't able to locate a proper guide which talks about applying for import export code online.

 

I checked on https://dgft.gov.in and it seems the whole process is online and we don't need to submit any documents by POST to the regional office... is this true ?

 

We discussed this with one import-export agent and he said that it's not completely online, and there is lot of offline work which goes in getting that... and he quoted like 5000 for the whole process. Is that reasonable and true ?

 

Also, one of the directors (who is also a major share holder of the company ) is outside India ... do we have to to specify "NRI interest" while filling the import export application ... and take approval from RBI for the same ? [I read   https://dgftcom.nic.in/exim/2000/IECONLINEHelp.pdf  and it says if there is any NRI interested we have to take approval from RBI]. Please clarify.

You are still missing the actual question I have posted. What if one of the major shareholder of the company (he is director also) is based outside India  ....  Do we have to do anything special ?

Divya, it is quite easy to apply for IEC. Yes, all documents need to be attached and the department as of now expects all those documents by post, even if you apply online. It generally takes no more than 3 days (I have applied for several IEC and have received it on the same day itself. Even after submitting the form online, you do need to send the supporting documents to your regional DGFT office.

IEC is one of the easiest applications to be submitted and the code to be alloted, so you do not need so much of research to get it done. You can do it yourself easily, if you are near to your regional DGFT office, then I would suggest just pay a visit with the completed form, the affidavit & the enclosures with the relevant fee (get a DD made) and or alternately get an agent to file it on your behalf. 3k is reasonable sum, 5k seems a bit out of place for such a small task, so I am sure you would be able to negotiate for 3k. In any case, whether it is 3k or 5k, this is for personal professional service, so the value of this service needs to be decided by you only.

Regarding foreign directors, I am sure you would have already applied for their DIN if they are already appointed as directors. It appears that the company you work for is a wholly owned subsidiary of a foreign company, in which case the only major issue you would face in future is that the Indian company might be deemed a PE, which is not desirable. So it is always desirable that the majority of directors are Indians, and all your board meetings take place in India.

There is no impact of whether the directors are foreign or national for applying IEC.

Thanks for the info. Luckily I got an email from some agent near Panipat DGFT. he is askiyag for 2200 but I think 2000 should be reasonable given that government fees is just 250 Rs. 1750 Rs professional fees will be fine I think.

IEC Code is unique 10 digit code issued by DGFT – Director General of Foreign Trade , Ministry of Commerce, Government of India to Indian Companies.

Full From of IEC Code is “Importer Exporter Code ”. To import or export in India, IEC Code is mandatory. No person or entity shall make any Import or Export without IEC Code Number.

as per para 2.8 (iii) of foreign trade policy 2009-2014, a person (exporter/ importer) is exempt from IEC code if they are importing / exporting  the goods for personal use / agriculture purpose.

As mentioned, you have applied and have been alloted several IECs'. I had a queary regarding original IEC Certificate. The IMC requires copy of the Original IEC Certificate for registration. However its been 20 days since I have been alloted IEC through online process but not yet received the Original IEC Certifictae. Some people did mention that the Original IEC is digitised and need to be printed directly by logging in to the application page. However, i have not been able to get any such print out. Ca your please help me out with the following questions:

1) Whether a physical copy of IEC is sent to the registered address in case of allotment through online application.

2) In case physical copy is not sent, how to take a prin out online and do I need to coungiure my PC settings for enabling me to take the print out.
