Applicability of PF Act

Hi,

I would like to know the provisions of PF Act in following circumstances:

1. Employees of the company drawing basic salary exceeding Rs.6500 makes a declaration for non deduction of PF from salary.

2. Whether the company has to get register under the PF Act when all the employees of the company with basic more than Rs.6500/- makes a declaration for non deduction of PF? What are the responsibility of company in this case.?(Currently number of employees is less than 20).

3. Is there any other provision where a company can avoid the applicability of PF Act with number of employees being 20 or more.

Employees' Provident Fund and Miscellaneous Provisions Act 1952 is applicable to:
  • Every establishment which is engaged in any one or more of the industries specified in Schedule I of the Act or any activity notified by Central Government in the Official Gazette. (List of Industries/Establishments)




  • and



  • Employing 20 or more persons .








  • Cinema Theatres employing 5 or more persons.

1)Deduction are applicable only to those who are drawing less than 6500

2) even if all the employees are drawing more than 6500................employer has to register.
