Ao appeals to tribunal on appeal order by cit (a)

The assessee is entitled to prefer an appeal to Tribunal on the CIT (A) order within 60 days from the date of order. The same applies to AO too. He can also appeal from the date of communication of appeal order from CIT(A)' s office to Office of AO. Now suppose 2 months have passed by and the assessee rejoices the AO has not gone to Tribunal and one fine morning Form 36 comes to assessee showing the date of communication after 2 months.

What can you really do ? There is no way to check how documents are communicated from on eoffice to another office in IT office and on whcih date the AO actually received the Order.

Any idea how to contest this, if at all.
