can anyone give us the salient features of the amnesty scheme?
we have paid the service tax but has not filed the return for the FY 2011-12. can we use this scheme?

1.Declaration possible only for the assessee with valid registration.if assessee is not registered then first obtain the registration.
2.The declaration in respect of tax dues is made in FORM VCES-1.
3.No cenvat credit can be utilised under this scheme that is whole amount is paid from PLA account.
4.A separate calculation sheet separately showing the details of tax dues needs to furnish tax return period wise and service wise if tax dues relate to more than one service.
5.Acknowledge will be granted by the designated authority in FORM VCES-2 with in seven working days from receipt of declaration.
6.Upon payment of tax dues the designated authority will issue in FORM VCES-3 with in seven working days from giving the details of tax dues.
yes you can use the amnesty scheme.

The features of the Service Tax Amnesty scheme, are:
1. Make a truthful declaration of pending service tax dues from Oct'2007 to Dec'2012,
2. Pay at least 50 per cent service tax dues before December 31, 2013,
3. Pay remaining 50 per cent service tax dues by June 30, 2014, or by December 31, 2014 with interest from July 1, 2014 onwards,
4. On compliance with all the requirements, get immunity from interest, penalties, and other proceedings.
You can avail the benefit of the sceme as it offers immunity from other proceedings too.
