Alteration of moa & aoa in compliance with companies act 2013

Is it mandatory to alter the exisiting MOA and AOA (Drafted under 1956 act) of a company to be compliant with the Companies Act., 2013? Kindly clarify

1) AOA - mandatory only at the time of making any alteration, otherwise optional [Ref. Sec.5(9)].

2) MOA - not mandatory since there is no similar provision for MOA.
