23 April 2013In Service tax Reverse Charge , Service reciver is to pay service tax on Advocate legal services. PL let us know what is Advocate as per Service tax rule. Our Sales tax practicioner is Advocate and is praticing Sales Tax. Is our company liable to pay service tax on this serive of Filling E Returns and E Activites related to Sales Tax given by advocate. For what purpoase advocate service are chargable to Service taxes.

Assuming that you are business entity with turnover of more than 10L.
Under the negative list regim and with almost all services covered, Service tax is applicable on the services by your advocate. Sec 65B defines the various services.
In my opinion your advocate should charge service tax in his/her invoice and discharge his liablity as the scope of the legal service does not cover filing of sales tax/vat returns...
