what if ADT 1 is not filed when appoint the auditor.. now what is the solution. pls tell me

Hello Bhaskar,

You have to file ADT-1 in any case, as when you go for annual filing AOC-4 & MGT-7 ask for the SRN of ADT-1 & without it you can't file the same also.

first auditor appointment I didn't file the ADT 1. now I have not file on time. what is the penalty

ADT-1 is not applicable for appointment of first Auditor, as first Auditor is appointed by Board and not by Members

in first AGM they appoint the auditor but they didn't file the ADT 1, however they are filling AOC 4 and MGT 7 every year. now 4 years completed. my question is now I need to file ADT 1 or can I file after next AGM after appointment of auditor.. pls clarify me..

See, for example, if you incorporate a company in May-14 then no need to file ADT-1 for the year ended 31-03-2015, now after that it is compulsory to appoint Auditor only in general meeting, accordingly from FY 2015-16 auditor will only be appointed in GM & in this case GM will appoint Auditor first time on 30-09-2015 (i.e First AGM) and within 15days company was required to file ADT-1, since you have not filed ADT-1 within due date, it is advisable to file ADT-1 with 12times late filings fee for the period of 5years from 01-04-2015 to 31-03-2020
