Dear all expert

Service tax received / due  from client and deposit to govt and later on same service is not provided

Question is can service tax paid to govt for which service is not provided be used for another service provided to same person.

if yes  then is there is any period for adjustment.

Thanks

Ritesh ji,

Did you mean ST paid to Govt. from advance received from client and later on services are not provided to the client. So, what about ST paid already??

Is it the same way  ??

I think , it is advance service tax recd from client ,

as per law tax on advance receipts of services charges to be paid if invoice is not raised within 14 days from the dt of receipts of advance.

first pl confirm have any invoice or advance reciepts been generated giving all the details regarding services.

Issue credit note to the party for the value of service not provided. Take credit of the tax paid in relation to the service not provided. This is as per rule 6(3) of the Service Tax Rules,

Service tax paid in advance can be adjusted against S.T. liability not exceeding Rs. 100000/-.
