80ddb - 2 people claiming for 1 dependent?

Tax queries 607 views 2 replies

My mom is suffering from CKD and we have already spent close to 5 lac on her treatment this year. Can I claim 60K (she is 61) and my father 60K for expenses towards her treatment or only one assesee can?

Also, how difficult is it to get the 10-I from Govt hospitals, is it easy or do you have to struggle, what are the charges (official and unofficial).

I guess not

Since drafting of 80DDB is like

".........dependant wholly or mainly on such individual or Hindu undivided family for his support and maintenance;"

Prior to amendment, words used were

 “dependant” means a person who is not dependant for his support or maintenance on any person other than the assessee;

[ It was giving an impression that if one has to claim deduction then dependant should not have got support from any other person] The word mainly was inserted to tackle this situation

I think that there can be only one person who can cliam deduction under this section

Hi,
I have undergone a treatment for malignant cancer in July 2014 from a private hospital in Pune. I have received a Medical certificate from my doctor stating the nature of the disease and the total cost involved.
Do I still need to submit government form 10-I from a government hospital to declare this under section 80ddb. If yes , from where do I get the form signed by government hospital since I availed the treatment from a private hospital. Please guide.
