I understand that short term stock market income, instead of being treated as capital gain, can be treated as business income under 44AD. No GST.

I read on Google that short term income from mutual funds can also be treated in this manner, as business income u/s 44AD, instead of being treated capital gain. No GST.

Comments?

Do not agree........ no evidence/case law in favour to sustain the claim.

On mutual funds you have STT (security es transaction tax) therefore they are securities like shares (STT applicable).

So they can be treated this way? Why not Sir?

STT is charged in lieu of capital gains liability; but main difference here is, all of these units are not traded on any RECOGNIZED EXCHANGE.

Those which are traded like equities, can no doubt be treated as business, but not otherwise.
