27q filing using single TAN

TDS 335 views 3 replies

We are two buyers for a NRI property.

I filed the TDS form 27q for the property purchased from NRI using a single TAN based on the lower tax certificate.

The seller has already filed the ITR and claimed the entire amount.

TDS team is sending intimation for short deduction and interest. I have paid the complete TDS +surcharge+cess. How can I ask for getting exception for 2nd buyer not paying TDS, since i already paid.

It appears that the NRI has mentioned only you as the buyer in its ITR, that's the reason you are getting demand intimation.

If you can approach the NRI and he revises his ITR to mention the correct proportion of respective buyers, then IMO this intimation would be sent to the other buyer.

Otherwise, you should visit the income tax office for this.

Thank you for the reply Manish. Since I filed one form 27q instead of two, the buyer also filed the ITR with single buyer. However I have filed with challan for the entire amount. I was trying to find the TAN AO, but "know your TAN" has no contact details.
