Respected Sir,
One of our client M\s XYZ Ltd.(Gujarat) has shown their stock as 1000000 units in the RG1 Register and also in their monthly returns and the VAT Auditor has also shown the same for FY 2007-08 but we have reported the same as 4000000 units per our 3CD reports and the annual reports now my query is that how do i bring an reconciliation in the same when the client's Excise Consultant has already given the signed indemnity bond for the shifting purpose in Sep 08 of the factory(Rajasthan)how do i come out of this position ??
one of the CA has advised me to show the balance as scrap sales, what should i do ??

Sir we R manufacturing of soya deoiled cake which is exempted from excise and vat also we have some export order we are planning to stuff the cointainer at our premises same will be exported we have also procure the bond and all necessary document we have done but my question wheater we can export under AR4 which container verification is nesseeriy.
Please guide me.

We have a Pvt. Ltd Co. and having production of Refined Oil & Soya D.O.C.
We are exporting the Soya D.O.C. & this product have no excise duty.
At present at the time of stuffing of containers for export, the officer from Excise department comes to factory inspect and seal the containers.
Is there is any provision in the Act for self removal of goods for export under AR-4. Because I heard that there is provision in the act for self removal of goods under AR-4 but it is for excisable goods.
Please clerify

Dear friends,
Please provide your inputs respect of reversal of Cenvat credit, availed on capital goods, at the time of retirement of asset:
Case1: Capital Asset (useful life 4 years) is retired within 1 year of its acquisition?
Case2: Capital Asset (useful life 4 years) is retired after 2 years but less than 4 years?
Case3: Capital Asset (useful life 4 years) is retired after its useful life i.e. 4 years?
As per second proviso of Rule 3(5) of Credit Rules: "Provided also that if the capital goods, on which CENVAT Credit has been taken, are removed after being used, the manufacturer or provider of output service shall pay an amount equal to the CENVAT Credit taken on the said capital goods reduced by 2.5 per cent for each quarter of a year or part thereof from the date of taking the Cenvat Credit".
What will be impact of this proviso in above mentioned cases?

Company has availed cenvat credit on Machinery which manufactures exempted goods.The company has not utilised the said credit till date.
Now the company wants to export the said machinery.Can teh company export the same against DEPB. If not than can the company claim the refund of cenvat credit of machinery not utilised till date

Dear Sir,
i am running a Steel tube cutting & threading business. I have installed a SSI unit and work of our unit is Cutting the long size pipe in stall picess (eg. 1", 2", 3", 4" .... etc.) and threaded these also. these goods are used in house for flow the water to various places eg. Kitchen, Bathroom, etc. and another pipe also produce in this unit (size 2.5 feet) which are use in agriculture. so please advise, Excise duty is applicable or not. if applicable than clear the limit of exemption. if Not applicable than please provide notification or case judgement related the same.
