Types of Trademark Searches
There are three main types of trademark searches:
Wordmark Search | This involves searching for specific words that are part of the mark name which can be search by typing the word and selecting the appropriate class for your products or services. Options like 'Start With,' 'Contains,' or 'Match With' help refine the search. |
Phonetic Search | A phonetic search looks for words that sound similar to your mark name. It helps to reduce confusion by ensuring that the mark is distinct from others in the market. This search method is similar to the wordmark search but focuses on phonetic similarities. |
Vienna Code Search | This type of search is used specifically to find trademarks with the same device or graphical element. You need to input the six-digit Vienna code associated with the device and select the relevant class. The search results display marks that share the same graphical representation. |
Process to Conduct the Trademark Search
- Visit the Trademark Registry's website at https://ipindia.gov.in/.
- Click on the "Trademarks" tab -> "Related Links" -> "Public Search."
- Choose the search type: "wordmark" or "Vienna code."
- Select the search parameter: "starts with," "contains," or "phonetically similar."
- Enter the proposed trademark name in the search box.
- Input the relevant class number for the mark.
- Click "Search" to generate results.
Classes of a Trademark
According to the NICE classification of trademarks, which is an international classification of goods and services, there are :
45 Classes | Divided into 34 classes for goods (1-34) and 11 classes for services (35-45). It is essential step before trademark search, determines the appropriate class for the product or service. |
Product (Goods) Classification | Classes 1-34 cover various types of tangible goods, from chemicals (Class 1) to furniture (Class 20) to pharmaceuticals (Class 5). |
