1. Login to the Income Tax e-Filing portal (https://www.incometaxindiaefiling.gov.in/) using your credentials.
2. Under the "Dashboard" section, click on the "Response to Outstanding Tax Demand" option.
3. Select the relevant Assessment Year (AY) for which you received the intimation demand.
4. You will see the details of the outstanding tax demand and the amount you have already paid.
5. Click on the "Submit" button to proceed.
6. On the next screen, you will see two options: "Demand is correct" and "Demand is partially correct." Since you have overpaid, select the option "Demand is partially correct."
7. Enter the correct details of the tax payment you made, including the challan number, BSR code, date of payment, and the amount paid. Ensure that the details you enter match the payment you made.
8. After providing the correct payment details, click on the "Submit" button.
9. The portal will generate a confirmation message indicating that your response has been recorded successfully.
10. The Income Tax Department will verify the information provided by you and update the demand accordingly. If there is any excess payment, it will be adjusted against any other pending tax liabilities or refunded to you, depending on your overall tax position.
Alternatively, you can also consider the following steps
1. Write a letter or an email to your jurisdictional Assessing Officer (AO) explaining the situation and attaching the necessary documents as proof of the excess tax payment.
2. Clearly mention your PAN, assessment year, and the details of the intimation received, including the demand amount and the amount already paid.
3. Request the AO to make the necessary adjustments and issue a revised intimation accordingly.
It is important to act promptly and communicate with the tax authorities to rectify the excess tax payment discrepancy. Keep all the relevant documents and communication records for future reference.
