heylo
well i am preapring for PCC May 09 started wid group one ....doing well in a/cz and audit....but i m really finding difficulties in studying law ...
can u please help me by guideing me for the same
and can u please tell mi how to attempt ans in exam
do i have to mug up aall the thing or just defination part and rest i can write on my own i mean explanatory part ..

hi, you should make notes will studying law, read scanner and find out important topics then make notes. notes should contain sections, caselaws, definitions. start making notes you will learn fast. no need to mug up . also you can read suggested ans they will help alot.

as suggested u need to make notes. it is preferable. no need to write the entire thing but its a good technique. Moreover, while attmepting to answer questions, it speaks better of you if you can write section numbers and quote relevant case laws, if any. Prepare well. All the best!

To answer legal questions, I would suggest you use the ‘IRAC’ method.. This means that when given a legal problem you:

Identify the ISSUE at hand.. This is where you will see what exactly is the legal issue that is involved in the problem.. Example: The issue could be "whether an individual can be deemed to be a dealer"
Then, you identify the RULE involved. Example: Section 2(b) of the CST Act, wihch defines a dealer to be one who carries on the business of buying, selling, supplying or distributing goods for cash......
Then APPLY the rule to the problem. It is here that you can include any case law that you may find which helps you concretize your line of reasoning Example: The individual here carries on the sale of rubber linings and collects cash in AP and thus would come within the scope of Section 2 (b). Moreover, in XYZ case of the Supreme Court a seller of rubber linings was held to be a dealer under the said Act.....
Then come to the CONCLUSION. Example: Thus, it can be concluded that the individual in question can be considered to be a 'dealer' as defined in Section 2(b) of the CST ACT, 1956.

This is a simple way to answer legal questions. Thus, your task is limited to identifying the issue and knowing relevant case law supporting your opinion. The rest is just common sense.. Hope this helps you pass your legal papers.. GOOD LUCK..
