Jointly Authored 16 books on Central Excise, Service Tax, Karnataka VAT and Excise / Service Tax audit, IDT - IPCC Study Material- November 2015 Examination, Handbook on CST and  GST- A Primer released in September August 2015.

    I would like to know whether a CA Firm providing output service can avail the cenvat credit of the excise duty paid on the capital goods like fax machine, computers, telephone, EPBX, Scanner and Photo Copy Machine?

    Case: There is an electrical contractor who undertakes the contract of commissioning, testing, installation of various electrical jobs for Nevilignte Thermal Power. He is also to buy the wires, cables, switches himself and install the same. The contract is composite as the company will make a lumpsum payment to the contractor (i.e for service as well as the wires cables and other accessories used). Question: Can the contractor take the input credit of the excise duty paid on the wires, cables, switches, accessories against the services tax liability?
