  • Ankur Shah says : Query
The nature of our business is that of an Agent who provides Services to Indian Sellers (mostly manufacturers). Our Services include promoting the Indian manufacturers' goods to prospective customers worldwide & generating business for them. For any business that has been generated by us for the manufacturer, we receive commission, as agreed between us & the manufacturers, in Indian Rupees. We raise our Invoice with commission agreed + service tax + cess Hence, our service comes under Business Auxilliary Service of the Service Tax Act. With new manufacturers, certain times we face a problem of explaining them to check with CENVAT rules about credit of Excise Duty against Service Tax paid in the commission paid to us. If somebody could inform us the rule no. / notification of CENVAT / Service Tax under which this credit can be availed by our manufacturers, it will be of great help.
