  • CA Saumil says : Service Tax Application
    Hello Sir, I am Saumil Shah, Practising C.A. from Ahmedabad. My client is a Builder who has availed registration of service tax under for construction of residential & commercial complex. We pay service tax on member's deposit received after deducting 75% abatement. As a result we did not get any CENVAT credit. Now, he has given labour work at the site to other party who charges service tax to us on labour bill under Works Contract service. In works contract service it is clearly said that, contract must be made in such a manner which includes property in goods required to be transferred. Now in our case, we have only given labour work to them without material and property is also in our own possession, then how can he charge service tax under Works Contract Service ? Is it Ok?

    sir if we provide same services to a co. in other country is service is applicable, if we receive payment in USD/EURO etc.

    Sir, I am the same person with the query on Service tax and WCT on AMC. My company falls under the category of service tax exempt cases and hence i do nt avail any cenvat credit. I wanted to just clarify how much WCT will be chargeable and will it be chargeable in any case at all
