Dear Sir, We are having a twenty room hotel in Moradabad. We have aroom tariff of Rs.950/- and on it we have been charging 10% service charge Rs, 95/- and so the total comes to Rs.1045/- and on the same grand total we give 20% discount i.e. Rs190/ and now balance comes out to Rs.855/- Thus guest pay us Rs. 855/-. Now recently the service tax department has audited our accounts and they say that we have to pay Service tax on Rs 1045/- inclusive of service charges, that is they say our room tariff comes to Rs.1045/-and not the displayed room tariff Rs.950/-, on which service tax is not applicable. Although the service charges are paid to room waiters on monthly basis. You are requested to clear this conception of service charges to be treated as part of room tariff because the service tax department has levied heavy penalty on this service charges ground. While creating the credit memo services tax should be deduct , but one of the cm not deducted services tax for same customer but rest of other customer cm deducted the services tax . Please tell me salutations issues is Oracle financial
