I am a Chartered Accountant, Cost Accountant and a Company Secretary. 

I am attached to Amalgamations group of Chennai. I am also on the Board of some of their group companies, besides being a CFO & CS of Simpson and Company Ltd..

    Thanks Mr.Raghavan. Few things are still not clear (1) Whether the amount in excess of Rs.3.50 lakh out of gratuity only or the total amount recd.(i.e., gratuity+ Lifecover)will be taxable? (2) In whose hands it will be taxable - the deceased employee or his nominee who received the gratuity ? Under the given circumstances whether the gratuity will be taxable on receipt basis or on accrual basis? Please clarify. Thanks.

    less amt is ded because thay dont know the rule.in 05-06and 06-07 thay have foollowed the same but now in 07-08 we as an auditor want to ractify the mistake.can we deduct the more amt and sattle it
