    suppose, if the tds deducted by bank is not deposited with the government, then how should I proceed further in the matter? Bank issued tds certificate to me but failed to deposit the tds with govt. I requested them to deposit the amount so that I can declare ITR for this year, but they did not do so and simply saying that the process of uploading is outsourced. How long I have to wait for the same as time to submit ITR is 31st july. How to deal with the matter now? Shall i take this matter to the Incometax department or any other forum to solve my problem. The form 16 of my company matches the details of tds in my 26AS.But, banks tds is missing in my 26AS. Can I submit the ITR without showing bank TDS? If I show then I have to pay the same TDS amount for the second time. Please suggest. THanks,

    Hi, One of my friend he has Income from Interest & Commision and the TDS amount is deducted by his account but the person(Deductor) hasn't filed TDS return nor paid for it, he hasn't received TDS certificate for the same A.Y. 2009-2010 Now the question is Can he claim for the refund of A.Y. 2009-10, if the Deductor pays for TDS later on(late payment of TDS with interest)??? he hasn't filed Income return for A.Y. 2009-10 too. Suppose If he had filed Income Tax return would he able to claim refund??? Is there any way to Claim for Refund?? or Can he ask from Deductor for Un-paid part of TDS????
