09 July 2014My elder brother working in Italy(Foreign County) and getting salary after the TDS deducted as per that country's rules and regualtion. He is receiveing such income in that country menas no repatried to the India. He is Resident of India as per Income tax, 1961. Now whether such income is taxable ot not in Indai. If yes then what could be used TDS deducted in Italy. Please Give urs suggestion.

If he is resident of india as per income tax act 1961 ,then Yes he is liable to pay tax in india subject to DTAA between India and Italy.
Tax paid in itay can be claimed as rebate while paying tax in india subject to DTAA.

What could be haapned if he is a non resident status as per Income Tax Act,1961. in the above case. Plz give your feedback.

In that case he is not liable to pay tax in india.

So he can be file ITR in India or Not ? If yes then in ITR-1 what should be filled and hows income are showing ?
